The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) announced it will stop requiring federal approval or registration for suppressors, short-barreled rifles, and short-barreled shotguns effective October 9, 2026. This change extends a Texas court ruling to all gun owners, not just the plaintiffs involved in the case. The decision follows a ruling by U.S. District Judge James Wesley Hendrix, who found that the National Firearms Act's registration and approval requirements were no longer justified after Congress eliminated the transfer tax on these items. The Justice Department chose not to appeal the ruling, leading to the agency's new enforcement policy. While the change applies broadly, it remains an enforcement discretion, not a repeal of the law. Several restrictions still apply, including the $200 NFA tax for machine guns and the requirement for Form 4473s and background checks. State and local laws remain unaffected, and ATF will continue processing NFA applications where required by state law.
